Introduction
Clips4Sale is committed to helping prevent and address the nonconsensual publication of intimate visual depictions, including intimate images, videos, and digital forgeries commonly referred to as “deepfakes.” This TAKE IT DOWN Act Policy explains how an identifiable individual, or an authorized person acting on that individual’s behalf, may request removal of an intimate visual depiction that was published on Clips4Sale without the individual’s consent.
This Policy is intended to comply with the Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act, known as the TAKE IT DOWN Act.
Scope of this Policy
This Policy applies to requests to remove an intimate visual depiction of an identifiable individual that was published on Clips4Sale without that individual’s consent.
For purposes of this Policy:
“Consent” means an affirmative, conscious, and voluntary authorization made by an individual free from force, fraud, duress, misrepresentation, or coercion.
“Digital forgery” means an intimate visual depiction of an identifiable individual created through software, machine learning, artificial intelligence, or other computer-generated or technological means, including by adapting, modifying, manipulating, or altering an authentic visual depiction, that, when viewed as a whole by a reasonable person, is indistinguishable from an authentic visual depiction of the individual.
“Identifiable individual” means an individual who appears in whole or in part in an intimate visual depiction and whose face, likeness, or other distinguishing characteristic is displayed in connection with that depiction.
“Intimate visual depiction” means an intimate image, video, or other visual depiction covered by the TAKE IT DOWN Act.
This Policy applies to authentic intimate visual depictions and digital forgeries.
How to Submit a Removal Request
An identifiable individual, or an authorized person acting on that individual’s behalf, may submit a TAKE IT DOWN Act removal request by contacting Clips4Sale through the following method:

For fastest handling, please include “TAKE IT DOWN Act Removal Request” in the subject line of any email request.
To allow Clips4Sale to evaluate and process the request, the request must include the following information:
Signature. A physical or electronic signature of the identifiable individual, or the authorized person acting on the individual’s behalf.
Identification of the Content. Information reasonably sufficient for Clips4Sale to locate the intimate visual depiction, such as the URL of the content, the Clips4Sale store name, clip title, screenshots, if helpful, the upload date, if known, or any other information that will help Clips4Sale locate the reported content.
Good-Faith Statement of Nonconsent. A brief statement that the identifiable individual has a good-faith belief that the reported intimate visual depiction was published without the individual’s consent. The statement should include any relevant information that may help Clips4Sale determine that the depiction was published without consent.
Contact Information. Information sufficient for Clips4Sale to contact the identifiable individual or the authorized person acting on the individual’s behalf, such as an email address or other preferred contact method.
If the request is submitted by an authorized representative, Clips4Sale may request information reasonably necessary to confirm that the representative is authorized to act on behalf of the identifiable individual.
Sample Removal Request
A removal request may use the following format:
I am the identifiable individual shown in the reported intimate visual depiction, or I am authorized to act on that individual’s behalf. I have a good-faith belief that the reported intimate visual depiction was published on Clips4Sale without the identifiable individual’s consent. I request that Clips4Sale remove the reported depiction under its TAKE IT DOWN Act Policy.

Clips4Sale’s Review and Removal Process
Upon receiving a valid removal request, Clips4Sale will act as soon as possible and, in any event, no later than 48 hours after receipt of the valid request, to:
remove the reported intimate visual depiction; and
make reasonable efforts to identify and remove any known identical copies of the depiction on Clips4Sale.
The TAKE IT DOWN Act requires covered platforms, upon receipt of a valid request, to remove the reported depiction and make reasonable efforts to remove known identical copies within 48 hours.
Clips4Sale may request information reasonably necessary to authenticate the identity of the requester, confirm authority to act on behalf of the identifiable individual, verify the authenticity of the request, and prevent fraud, abuse, or misuse of this process.
Clips4Sale may remove or disable access to content while reviewing a request if Clips4Sale determines, in good faith, that removal or disabling access is appropriate under this Policy, the TAKE IT DOWN Act, Clips4Sale’s Terms of Service, Clips4Sale’s Acceptable Use Policy, or applicable law.
Clips4Sale may maintain records of requests, communications, decisions, technical identifiers, and enforcement actions for auditing, legal compliance, and repeat-abuse prevention.
Incomplete or Insufficient Requests
If a request does not include enough information for Clips4Sale to locate the reported content or determine that the request is covered by this Policy, Clips4Sale may request additional information.
A request may be delayed or rejected if the requester does not provide information reasonably necessary to process the request, including information sufficient to locate the reported content.
Good-Faith Removal
Clips4Sale may disable access to or remove material reported as a nonconsensual intimate visual depiction when Clips4Sale acts in good faith based on the information available to it. Clips4Sale may also remove content that violates Clips4Sale’s Terms of Service, Acceptable Use Policy, Content Rules, performer documentation requirements, consent requirements, or applicable law, even if the content is not ultimately determined to violate the TAKE IT DOWN Act.
The TAKE IT DOWN Act provides that a covered platform is not liable for claims based on the platform’s good-faith disabling of access to or removal of material claimed to be a nonconsensual intimate visual depiction, regardless of whether the depiction is ultimately determined to be unlawful.
False, Misleading, or Abusive Requests
Removal requests must be submitted in good faith. Clips4Sale may reject requests that appear fraudulent, abusive, materially incomplete, or submitted for an improper purpose.
Submitting false or misleading information may result in account action, including suspension or termination, and may have legal consequences.
Relationship to Other Clips4Sale Policies
This Policy is in addition to Clips4Sale’s other reporting and enforcement procedures, including procedures for reporting:
child sexual abuse material or suspected exploitation of minors;
nonconsensual content;
content uploaded without required performer authorization;
copyright infringement;
impersonation;
harassment, abuse, or unlawful content; and
violations of Clips4Sale’s Terms of Service or Acceptable Use Policy.
If reported content involves a minor or suspected child sexual abuse material, Clips4Sale may remove the content, preserve relevant information, report the matter to appropriate authorities or organizations, and take other action required or permitted by law.
This Policy applies only to requests that seek removal of content alleged to constitute a nonconsensual intimate visual depiction within the scope of the TAKE IT DOWN Act. Clips4Sale may review and act on reports under this Policy, the Terms of Service, the NCC Policy, the CSAM Policy, the Content Rules, or any other applicable policy or law, as appropriate.
No Waiver of Other Rights or Remedies
Nothing in this Policy limits Clips4Sale’s right to remove, disable, restrict, demonetize, or otherwise act against any content or account for any reason permitted by Clips4Sale’s Terms of Service or applicable law.
Nothing in this Policy limits any rights or remedies available to Clips4Sale, any identifiable individual, or any other person under applicable law.
